Guaranteed Rental Returns: Who Pays for Them

A guaranteed rental return is a debt owed by a counterparty, not income earned by a building. In resort and off-plan markets the principal should ask who pays it, with which assets, whether the unit price already funds it, and what the income does on the day the guarantee ends. This piece sets out the method and a declared-illustrative worked example.

أبرز النقاط

  • - A rental guarantee is a debt owed by a counterparty, usually the single-asset vehicle that sold the unit, so its quality is that vehicle's balance sheet (Victaura Research method, no data claimed).
  • - In the illustrative example an 8% guarantee on a 400,000 unit for 3 years has a present value of 85,536 at a 6% discount rate, against a premium of 60,000 over a 340,000 comparable (illustrative arithmetic, not market data).
  • - The same example leaves the principal paying 15,361 more than the guarantee is worth, before default risk, and shows income falling 52% in year 4, from 32,000 to 15,300, with cash yield on price moving from 8.0% to 3.8% (illustrative arithmetic).
  • - Dubai's Law No. 8 of 2007 dedicates the off-plan escrow account exclusively to construction (Article 9) and has the escrow agent retain 5% until one year after unit registration (Article 14), so it protects completion and does not fund rent (Dubai Land Department, statute, measured).
  • - Knight Frank put Dubai apartment gross yields at 5 to 7% and villa and townhouse yields at 4.5 to 6% (Destination Dubai 2025, 21 May 2025, industry estimate, gross), the external reference against which a guarantee rate should be read.
  • - On 12 February 2025 the ASA upheld a complaint about a 'guaranteed return' of up to £83,454 over two years, because the advert did not explain that the guarantee covered optional sublet income, was based on a minimum occupancy rate of 80% and ran for 12 to 24 months (ASA ruling, measured).
  • - The FCA reported on 1 August 2023 that a care home room scheme promising 8 to 10% had raised £57 million from 380 investors and that the court agreed the returns were never likely to be achievable (FCA press release, measured, not a resort case).
  • - The FCA says unregulated collective investment schemes cannot be promoted to ordinary investors, and the CNMV treats high returns promised with little or no risk as a red flag, while proceedings over a £23 million scheme begun on 29 July 2025 remain allegations, on hold against the lead company since its administration was reported on 12 March 2026 (FCA and CNMV guidance, FCA press release, trade report).

What is a guaranteed rental return, and who pays it?

A guaranteed rental return is a contractual promise by a named party to pay the owner of a unit a fixed income for a fixed period, whatever the unit actually earns. In resort and off-plan markets the promise is often expressed as a percentage of the purchase price for a fixed term of a few years (Victaura Research assumption, no dataset claimed). The principal's first question is not whether the percentage is high. It is who writes the cheque in year two.

A guarantee is a debt, not an income. Income is earned by letting the unit to guests or tenants. A guarantee is owed by a counterparty, so its quality is the quality of that counterparty's balance sheet, and its cost is whatever was added to the price to fund it. Read this way, the headline percentage is a financing term. It belongs in the same part of the model as a vendor loan, and it should be underwritten with the same suspicion.

Three questions decide whether a guarantee is worth anything. Who is obliged to pay, and with which assets behind them? How much of the payment was already collected in the price? And what does the income do on the day the guarantee ends? The sections below take each in turn, then test the clauses that sit under the percentage, and then the way a guarantee interacts with a rental pool and with a completion guarantee.

This piece belongs to a series on what developers promise and what the promise covers. The companion article on what a completion guarantee actually covers deals with the promise that a building will be finished. A rental guarantee is the next promise in the chain, and it depends on the first one being kept. No operator or platform is named here, and the arithmetic in the table is illustrative, not market data.

A guarantee is a debt, not an income. Its quality is the quality of the debtor.

Who stands behind a rental guarantee, and with what assets?

In a common structure, by Victaura Research assumption rather than a measured share, the guarantor is the vehicle that sold the unit. The sales contract is signed with a project company, and the guarantee is a clause in that contract or in a side agreement signed on the same day. The company usually has one asset, the project, and one source of cash, the instalments paid by buyers. A guarantee from such an entity is only as strong as the project it sits inside, and the principal is lending to that project twice, once with the price and once with the promise.

A guarantee funded by the same cash that builds the project is a circular promise. In Dubai, Law No. 8 of 2007 requires buyer payments for off-plan units to go into a project escrow account. Article 9 dedicates that account exclusively to construction of the project and bars attachment of the deposited payments by the developer's creditors. Those protections serve completion. The reading of Victaura Research, which is not legal advice, is that the account is not a source for rent payments, so the guarantee has to be paid from assets outside it, and the principal should ask where they are.

A parent guarantee, a bank guarantee and a funded reserve are three different things. A parent guarantee adds a second balance sheet but remains an unsecured claim. A bank guarantee or standby letter of credit puts a regulated lender behind the payment, and it costs the guarantor money, which is a reason to ask whether that cost was priced into the unit. A reserve held by a third party is the strongest form, because the cash exists before the first payment falls due and cannot be redirected to the next phase.

Enforcement is the second half of the counterparty question. A 2017 commentary by an in-house legal counsel, published on 19 November 2017, noted that the regulatory framework for rental guarantees in Dubai was fairly limited, that no formal security requirement applied to developers offering them, and that investors would probably need court proceedings or arbitration to enforce (legal commentary, dated, not a statute). The principal should read the governing law, the seat of arbitration and the place where the guarantor's assets sit before accepting any percentage.

Is the rental guarantee already in the price?

A rental guarantee is already in the price whenever the unit is priced above a comparable unit sold without one. The test is arithmetic. Take the guaranteed payments, discount them at a rate that reflects the guarantor's credit, and compare the present value with the premium paid over the comparable. If the premium is larger than the value of the subsidy, the principal is paying more than the guarantee is worth, before any allowance for default.

The comparable is the hard part, and it is usually missing. Sellers who offer a guarantee rarely offer the same unit without one. The principal can approximate the comparable from resale listings, from other projects in the same micro-market, or from an independent valuer's opinion, all directional, because off-plan prices are asking prices until a transaction closes. Where no comparable exists, the premium cannot be measured, and the guarantee should be treated as fully priced in.

The table below is a worked example, declared illustrative. It uses round numbers that belong to no market and no project. A unit is priced at 400,000 and a comparable without a guarantee at 340,000, a premium of 17.6%. The guarantee pays 8% of the price for three years. At a 6% discount rate the guaranteed stream is worth 85,536, against a net rent the principal could underwrite of 15,300 a year, worth 40,897 over the same three years.

The subsidy is 44,639, and the premium is 60,000. The principal has paid 15,361 more than the guarantee is worth, before default risk. The payments are a rebate of the buyer's own money, returned over three years, and the seller keeps the difference. The right comparison is therefore not 8% against a bank deposit. It is the net rent against the price actually paid, and the guarantee is a rebate schedule laid on top of it.

What happens to the income when the rental guarantee expires?

The step at expiry is the largest single number in the model, and it is rarely shown. In the worked example the income falls from 32,000 to 15,300 in year four, a drop of 52%. On the price paid of 400,000, the cash yield moves from 8.0% to 3.8% overnight. A principal who underwrites year one and assumes it persists is underwriting a contract that ends, and the sales material is built to keep the step out of view.

The distance between the guarantee and the market is the measure of how much was borrowed from the future. Market gross yields are the external check. Knight Frank's Destination Dubai 2025, published on 21 May 2025, put apartment gross yields at 5 to 7% and villa and townhouse yields at 4.5 to 6% (industry estimate, gross, before operating costs, one market only). The example itself belongs to no market, but a guarantee above the market range for its asset type is, by arithmetic, a payment funded by something other than the market.

A fixed return funded by a single vehicle can fail at the vehicle, not at the building. The FCA reported on 1 August 2023 that a High Court had found a care home room scheme to be an unauthorised collective investment scheme. Investors had bought long leases in rooms, sublet them back to the operating companies and been promised 8 to 10% of the purchase price. The court agreed that the returns promised were never likely to be achievable (regulator press release, measured). The case concerns care homes, not resorts. It shows what an unfunded guarantee is.

A principal should model three exits. First, the income falls to the underwritable net rent, as in the example. Second, the income falls to the net rent and the unit trades at the comparable price, so the premium is crystallised as a loss. Third, the guarantor is in default before expiry. The third case is the one that sellers do not show, and it is the one an allocator is paid to price. Where a fixed buy-back is offered at the end of the term, it is one more promise from the same guarantor and should be underwritten as such.

Which rental guarantee clauses suspend, cap or claw back the payment?

The clauses that matter sit under the percentage. Four recur in guarantee contracts. Conditions precedent, such as handover on a stated date or the buyer joining an operator's programme. Suspension events, such as force majeure or the unit becoming unusable. Caps and set-offs, which limit the total payable or net it against sums the buyer owes. And clawback, which lets the seller recover guaranteed payments in stated circumstances, for example on an early resale. Each of them turns a guarantee into an option held by the seller.

The UK Advertising Standards Authority has ruled on how limited a 'guarantee' can be. On 12 February 2025 it upheld a complaint against an advert promising 'up to £83,454 over two years guaranteed return based on historical success'. The ruling found that the return related to rental income from an optional sublet scheme, and that the advert did not explain how the guarantee worked, including that the guaranteed income was based on a minimum occupancy rate of 80% and that the programme ran for a minimum of 12 and a maximum of 24 months (regulator ruling, measured).

An earlier ruling shows the same pattern in a residential letting guarantee. In a ruling reported on 21 November 2018 the ASA found a London letting agency's 'rent guarantee' misleading because the firm became the tenant and sublet the property, and because exclusions, including the property becoming uninhabitable, were not made clear (ruling as reported by a trade publication). Landlords, the authority concluded, would understand the phrase as a specific guarantee of payments. The wording of the promise ran ahead of the wording of the contract.

Both cases are UK matters, one on holiday lodges and one on residential lets, and neither is evidence about any other market. They are cited because they show how a regulator reads the word 'guarantee' when the conditions sit in a document the reader has not seen. A principal can reuse the test. Ask for the full contract before the reservation payment, and find every condition under which the payment stops, reduces or comes back. A clause the seller will not show is a clause the principal should assume is adverse.

How does a rental guarantee interact with the rental pool?

A rental pool shares the income of many units among their owners, and a guarantee changes who bears the variance. In a classic pool, owners receive a share of net revenue after operator fees, so a weak season reduces income. A guarantee replaces that share with a fixed sum for a fixed period and moves the variance to the guarantor. That is the whole economic content of the guarantee, and it should be priced as the sale of volatility, not as extra yield.

The pool and the guarantee are often layered, and the layering has to be read. Typical arrangements guarantee a minimum and then pass through pool income above it, or let the guarantee lapse and enrol the unit in the pool afterwards. In the first case the principal should ask whether the excess is shared or retained by the operator. In the second, the step at expiry is the move from a promised income to a pooled one, and the first pooled year is the first honest test of the unit.

Where pool participation is a condition of the guarantee, the structure may fall inside collective investment regulation. Section 235 of the UK Financial Services and Markets Act 2000 defines a collective investment scheme as arrangements enabling participants to share in profits or income from property, where contributions and income are pooled or the property is managed as a whole by or on behalf of the operator. The FCA lists hotel rooms among assets that are tricky to value at any given time (UK statute and regulator guidance, measured, UK perimeter only).

For a principal, the practical question is the exit from the pool. Who manages the property as a whole, what the owner can do with the unit if the operator fails, and whether the guarantor and the operator are the same company. If they are, the principal holds one counterparty in three roles, guarantor, manager and seller, with nobody on the other side of the table to check any of them. Fractional villas in Bali applies the same logic to shared holdings.

Where does a rental guarantee meet a completion guarantee?

A rental guarantee presumes a finished building, so it is only as reliable as the completion promise beneath it. The guarantee clock normally starts at handover or on the first day of operation. If handover slips, the clock slips with it. The principal's income then starts later than modelled while the payments for the unit are already sunk, and the guarantee, however generous, has not yet begun to run.

The two promises should be read together, because the second can quietly depend on the first. The companion piece on what a completion guarantee actually covers deals with the first promise. The point here is the join. A rental guarantee that begins on 'practical completion' leaves the principal uncovered for the whole delay period unless a long-stop date is written in, and a long-stop date without a remedy is only a date.

The join has three seams. The definition of completion in each document may differ, so a building can be complete for one clause and not for the other. Delay compensation, if any, may be paid in cash or as a credit against the final instalment. And the termination right on long delay may extinguish the rental guarantee together with the sale. The principal should line the definitions up in one table before signing, and note which document controls if they disagree.

In Dubai the statute gives a floor on the construction side only. Law No. 19 of 2017 (Article 11) sets how much a developer may retain on buyer default, up to 40% of the unit value where works are at least 60% complete, up to 25% below that, and up to 30% of the amounts paid where works have not started, and it requires the developer to refund all purchaser payments when a project is cancelled, under the procedures of Law No. 8 of 2007. Article 14 of Law No. 8 has the escrow agent retain 5% of the account value after completion, released one year after unit registration (statute, measured). None of it guarantees rent.

If the unit only works with the guarantee, the unit does not work.

What do regulators say about guaranteed returns?

Regulators in two jurisdictions treat the promise of a guaranteed return as a warning sign, not as a feature. The UK FCA says that unregulated collective investment schemes are typically high risk and cannot be promoted to ordinary investors, and that anyone investing in one should be prepared to lose all their money (regulator guidance, page first published 10 July 2026 and updated 16 July 2026). Its Handbook rule COBS 4.6 requires that a communication citing past performance state the period and the source and carry a prominent warning that past performance is not a reliable indicator of future results.

Spain's CNMV makes the same point from the retail side. Its investor guidance advises distrust of high returns promised with little or no risk, because returns are normally related to risk, and it treats claims such as 'you cannot lose' as indicators of fraud (regulator guidance, undated). The guidance concerns unauthorised investment services. It is not a statement about property developers as a class, and it is cited here for the principle, not for any specific seller.

The line between a legitimate guarantee and a regulated product is substance, not label. In the care home case reported by the FCA on 1 August 2023, the High Court found an unauthorised collective investment scheme and agreed that the promised returns were never likely to be achievable. On 29 July 2025 the FCA began proceedings over a scheme sold on 'fixed returns' in which consumer investments exceeded £23 million (regulator press release, allegations only). On 12 March 2026 a trade publication reported that the High Court had placed the lead company into administration and that the FCA had put its proceedings against that company on hold, while its claim against the other defendants continues.

None of this means that a guaranteed return is unlawful or fraudulent. A guarantee can be honoured in full, and a well-capitalised guarantor can make it credible. The point for the allocator is narrower. The word 'guarantee' is not evidence of the asset behind it, and the language of the regulators is a reminder to test the second. A seller who welcomes that test has lost nothing, and a seller who resists it has told the principal something.

How does an allocator underwrite a rental guarantee?

An allocator underwrites a rental guarantee by stripping it out and pricing what remains. Step one is to price the unit as if the guarantee did not exist. Step two is to value the guarantee separately, at a discount rate above the principal's own cost of capital, because the counterparty is usually a single-asset company. If the unit only works with the guarantee, the unit does not work, and the guarantee is hiding that fact for three or five years.

Six questions turn that into a test. Who is the guarantor, and what assets sit outside the project? Is there a bank guarantee, a funded reserve or a parent covenant? What is the present value of the payments against the premium over a comparable? What stops, suspends or reclaims the payment? Where does the income land at expiry? And do the guarantor, the operator and the seller share an owner? An answer to each, in writing, is the minimum.

The documents to request are few and specific. The sale and purchase agreement, the guarantee agreement if it is separate, the operator or management agreement, the pool rules if any, the guarantor's latest financial statements, and evidence of any security. A seller who cannot supply the guarantor's accounts has answered the first question. Where the unit is sold before completion, the principal should add the escrow account details and evidence that the account is project-specific.

A guarantee has value, and the allocator should be willing to say so. It shortens the period of uncertainty at the start of operations, when ramp-up is slowest, and it can align the seller with early performance. The discipline is to buy it at its fair value, as a separate asset, with its end date in the model from day one. Before the guarantee comes the title, and what a foreign holder gets on Gili Air shows the same test applied to the asset itself.

The word guarantee is not evidence of the asset behind it.

Where is this rental guarantee analysis weakest? Honestly disclosed

The worked example is illustrative, and every input is chosen by the author. The 340,000 comparable, the 6% discount rate, the 4.5% net rent and the 8% guarantee are round numbers that belong to no market and no project. Change the premium or the discount rate and the conclusion changes. What survives is the method, not the figures, and a reader should rerun it with the numbers of the deal in front of them.

The external data are narrow. The market yield ranges come from one broker report for one market, are gross, and are industry estimates. The regulatory material is largely UK and Spanish and concerns different asset types, care homes, static homes, lodges and residential lets. The rulings are single decisions, the legal commentary on Dubai dates from 2017 and may no longer describe current practice, and the statutes were read by a non-lawyer author. The Concept Capital matter remains an allegation, and the latest report read, of 12 March 2026, records the lead company's administration and no court finding on the FCA claim.

Several things are not known. There is no public dataset that Victaura Research could verify on how often rental guarantees are paid in full, how often they are suspended, or how large the premium is on average, so none of those is claimed here. A principal should treat any seller statistic on guarantee performance as broker-reported until the underlying payment records are shown, and should treat the absence of such records as information.

The conclusion is conditional. A guarantee is a financing term, to be valued by the allocator as such. It is neither a fraud nor a gift. Where the guarantor is strong, the premium is small and the step is modelled, it can be a fair trade. Where any of the three is missing, it is a rebate of the buyer's own money, paid out slowly and ending on a date the brochure does not mention.
