Lake Como Short Lets: CIN, Flat Tax, Local Rules
A short let on Lake Como in 2026 meets four sets of rules, the national CIN, the Lombardy CIR, the income-tax text that moves into the new tax code on 1 January 2027, and each comune's tourist tax. The business presumption starts at the third apartment. This note reads the texts as published and says where no official figure was found.
IllustrationKey takeaways
- - A Lake Como short let sits under four rule sets at once, the national CIN, the Lombardy CIR, the income-tax text and the municipal tourist tax (Decree-Law 145/2023 art. 13-ter; Regione Lombardia CIR page; Legislative Decree 117/2026; Legislative Decree 23/2011 art. 4).
- - Letting without a CIN carries a fine of €800 to €8,000, and not showing it €500 to €5,000, unless regional law sanctions the same conduct (measured, statutory text, Decree-Law 145/2023 art. 13-ter paras 9 and 10).
- - A short let in business form needs the SCIA at the municipal one-stop office, and the omission is fined at €2,000 to €10,000 (measured, statutory text, art. 13-ter paras 8 and 9).
- - Lombardy keeps its own CIR, generated by ROSS1000, and the Region's page does not mention the CIN. The Ministry's FAQ, read through a CNA reproduction updated to 17 October 2024, says both codes must be displayed (directional; Regione Lombardia CIR page; resolution XII/169 of 19 April 2023).
- - From tax year 2026 the flat-tax regime is recognised for no more than two apartments per tax period, and above that the activity is presumed to be a business (measured, statutory text, Law 199/2025 art. 1 para. 17; income-tax code art. 207 para. 4).
- - Most of article 4 of Decree-Law 50/2017 is repealed from 1 January 2027 by Legislative Decree 117/2026, in force from 4 July 2026, and article 207 of the new code then reads 26 percent on the option and 21 percent for one chosen unit (Normattiva; arts. 207 and 377 read through a reproduction).
- - Intermediaries transmit contract data by 30 June of the following year and apply a 21 percent withholding on account, and the tourist-tax declaration also falls on 30 June (income-tax code art. 208, read through a reproduction).
- - No tourist-tax rate for Como, Bellagio or any other lake comune was found on an official text, the national default ceiling is €5 per night, and a professional should read the rules for the unit (Legislative Decree 23/2011 art. 4).

What does a Lake Como short let require in 2026?
A short let on Lake Como in 2026 sits under four sets of rules at once, and the principal has to read each one separately. The first is the national identification code, the CIN, created by article 13-ter of Decree-Law 145/2023. The second is the Lombardy regional code, the CIR, under regional law 27/2015. The third is the income-tax text on short lets, which sits in article 4 of Decree-Law 50/2017 and paragraph 595 of Law 178/2020 and from 1 January 2027 moves to articles 207 and 208 of the new consolidated income-tax code. The fourth is the municipal tourist tax, which each lake comune sets for itself.
The CIN is the key the national registry uses to identify a unit let for tourism. The Codice Identificativo Nazionale (CIN) is assigned by the Ministry of Tourism through an automated procedure, on a telematic application with a self-certification under Presidential Decree 445/2000. The text requires it to be displayed outside the building and quoted in every advertisement, and portal operators carry the same duty. That is the content of paragraphs 1, 3 and 6 of article 13-ter, as reopened on Normattiva on 24 October 2026 (measured, statutory text).
The business line is the variable that changed most. Law 199/2025, article 1, paragraph 17, cut the apartment ceiling of the short-let regime from four to two, and the income-tax text now presumes a business above two apartments in a tax year. One lake house sits below that line if it is the owner's only short-let apartment. Three units let by the week do not. The sections below follow each layer in turn, with the article that carries it and the grade of each figure.
This note reads texts. It does not say what any owner owes or must declare. Whether a given pattern of lettings falls inside or outside a rule depends on facts the note does not have, such as who owns the units, how they are held and how often they are let. That question belongs to an Italian tax adviser or lawyer. Questions of title, such as direct water access on Lake Como, are a separate matter and are read elsewhere.
What is the CIN on Lake Como, and what does skipping it cost?
The CIN is a national code for each unit let for tourism, and letting without it carries a fine of €800 to €8,000. Paragraph 9 of article 13-ter sets that range for operating without a CIN, with the amount tied to the size of the unit or structure. The code is assigned by the Ministry of Tourism through an automated procedure (measured, statutory text).
The other fines attach to display and to business form. Failing to show or quote the CIN carries €500 to €5,000 per structure or unit, with immediate removal of the irregular advertisement. A unit let in business form without the SCIA, the certified start-of-activity notice filed with the municipal one-stop business office, carries €2,000 to €10,000. Missing detectors or extinguishers carry €600 to €6,000 per violation. Each range is a statutory band, and the amount in a case is for the authority (measured, statutory text).
The safety duties are written into the same article. Paragraph 7 requires working detectors for combustible gas and carbon monoxide and portable extinguishers, one per 200 square metres of floor or fraction, with at least one per floor. The extinguisher type follows Annex I of the Interior Ministry decree of 3 September 2021. Units let in business form must also meet the safety requirements for systems under state and regional rules. The text applies the detector and extinguisher duty to every unit let for tourism.
Enforcement sits with the comune, and the tax authorities are told to look for units without a code. Paragraph 11 gives the checks and the fines to the comune where the unit stands, through its local police, and the fine revenue goes to that comune. Paragraph 12 has the Revenue Agency and the Guardia di Finanza, the financial police, run joint risk analyses to target those who let without a CIN. Paragraph 10 adds that the national fines do not apply where regional law sanctions the same conduct. I did not establish whether Lombardy law does so for a missing CIR.
The Lake Como short let is four rule sets, not one. The CIN is national, the CIR regional, the income-tax text national again, and the tourist tax belongs to the comune.

Does Lombardy still require its own code next to the CIN?
Lombardy keeps its own code, the CIR, and the Region's page on the CIR does not mention the CIN. The page says the CIR applies to all tourist accommodation governed by regional law 27/2015, including apartments let for tourist purposes under national law 431/1998. It describes the code as the regional code generated by the ROSS1000 tourist-flow system (measured, Regione Lombardia page, read 24 October 2026).
The legal basis is regional. Article 38, paragraphs 8-bis and 8-ter, of regional law 27/2015, added by regional law 7/2018, requires the code to be shown in advertising and offers, and extends the publication duty to intermediaries and portal operators. The current rules for the code are set by Regional Government resolution XII/169 of 19 April 2023. In the 2018 wording, as reproduced by Edizioni Europee, paragraph 8-bis made the code correspond to the protocol number issued on receipt of the start-of-activity notice (measured, statutory text via reproduction, 2018 wording).
The procedure runs through the municipal one-stop office. For apartments let for tourism under law 431/1998, and for holiday homes and apartments, the Region's page says the filing is a CIA, a communication of start of activity. Hotels, residences and non-hotel structures such as bed and breakfasts file a SCIA. The comune forwards the filing to the Province or the Metropolitan City of Milan, which opens the property's section in ROSS1000 and gives the applicant access, where the CIR then appears.
How the CIN and the CIR sit together is the open point. Article 13-ter, paragraph 2, tells local bodies that already run code systems to recode their codes as CINs, and paragraph 5 makes that recoding depend on verification. The Ministry's FAQ, as reproduced by the trade association CNA with an update date of 17 October 2024, says the CIN does not replace the regional or provincial code and that both codes must be displayed. The FAQ was read through that reproduction and not on the Ministry's site, so the reading is directional and dated. The principal should assume two identifiers may be in play until a professional confirms otherwise for the unit.
At what point does a Lake Como short let become a business?
Under the text now in force, the line is the third apartment. Paragraph 595 of Law 178/2020, restated from 1 January 2027 in article 207, paragraph 4, of the income-tax code, recognises the short-let regime only where no more than two apartments are devoted to short lets in each tax period, from tax year 2026. Above two, the activity is presumed to be carried on as a business under article 2082 of the civil code, whoever carries it out (measured, statutory text, read through a reproduction).
The two-apartment ceiling comes from a budget law. Law 199/2025, article 1, paragraph 17, rewrites the first sentence of paragraph 595 of article 1 of Law 178/2020 in two places. The year reference moves from 2021 to 2026, and the number of apartments from four to two. Normattiva shows the amendment as taking effect on 1 January 2026. Under the previous wording, with a ceiling of four apartments, the presumption started at the fifth (measured, statutory text).
The presumption reaches contracts concluded through intermediaries. The last sentence of paragraph 4 applies the same rule to contracts stipulated through real-estate agents and online platforms, so routing bookings through a portal does not change the count. The primary text says the activity is presumed to be carried on as a business, and it does not say here how a principal could displace the presumption.
Business form changes the obligations that sit on the unit. Article 13-ter, paragraph 8, subjects a short let in business form to the SCIA filed with the municipal one-stop office, and paragraph 9 fines the omission at €2,000 to €10,000. What else follows from business status, for value-added tax, accounts or social contributions, I did not read in a primary text and do not state. How units are counted for co-owners, for spouses or for sublets, which paragraph 3 of article 207 brings into the same regime, is for the professional.
How does the flat tax on a Lake Como short let read?
The flat tax on short lets is an elective substitute tax, and its text is moving. The cedolare secca is the substitute tax on rental income that an owner can elect in place of the ordinary income-tax treatment of the rent. Article 207 defines short lets as residential leases of no more than 30 days, made by individuals outside a business, directly or through agents or online platforms, and sets the rate at 26 percent on the option (measured, statutory text via reproduction).
The reduced rate is 21 percent and attaches to one unit. The same paragraph reduces the rate to 21 percent for the income from short-let contracts on a single property that the taxpayer identifies. The article also applies articles 203, 204, 205(1) and 206 of the code to the mechanics of the substitute tax, which I did not read.
Older citations point to a text whose repeal takes effect on 1 January 2027. On 24 October 2026 the Normattiva page for article 4 of Decree-Law 50/2017 showed paragraphs 1, 2, 3, 5, 5-bis, 6 and 7 marked as repealed by Legislative Decree 117/2026 of 19 June 2026, in the text in force from 1 January 2027. That decree is the new income-tax code, published in the Gazzetta Ufficiale of 3 July 2026 and in force from 4 July 2026. Its article 377 applies its provisions from 1 January 2027. The reproduction of article 207 states that it draws on paragraphs 1 to 3 of the old article and on paragraph 595 of Law 178/2020. Until 31 December 2026 the old numbering still governs (measured, statutory text).
The text sets a rate and a regime, and nothing in it says what a given owner pays. Paragraph 3 extends the regime to gross income from sublets and paid lodging under the same conditions. The amount due depends on the rent, the elected regime and the owner's position, and on whether the regime is available at all. This note does not compute it. A figure that comes from a listing site or an agency carries the grade of that site, and the statute does not endorse it.
From the third apartment, the text presumes a business. A single lake house that is the owner's only short-let unit stays below the line.

Who collects and reports a Lake Como short let booked through a platform?
The intermediary carries three duties under article 208 of the income-tax code, which applies from 1 January 2027. Real-estate intermediaries and managers of online portals transmit the data of the short-let contracts concluded through them, by 30 June of the following year. Resident intermediaries that collect the rent or intervene in the payment apply a withholding on account of 21 percent, as tax substitutes. Non-resident intermediaries act through a permanent establishment or, outside the EU without one, through a tax representative (measured, statutory text, via reproduction).
The withholding is on account, so it is a payment toward a liability. The wording is a withholding of 21 percent 'a titolo di acconto'. It is applied when the rent is paid to the beneficiary, and the remittance and certification follow the rules set in the text. A decision of the Director of the Revenue Agency sets the implementing rules for data transmission and retention. The text I read contains no sanction provision of its own for these duties.
The tourist tax follows the money. Paragraph 4 of article 208 makes whoever collects the rent, or intervenes in the payment, liable for the tax and the contribution of stay, with a right of recourse against the guests. The declaration is filed cumulatively and only electronically, by 30 June of the following year. Article 4 of Legislative Decree 23/2011 says the same for operators of accommodation facilities and sets the sanctions (measured, statutory text).
The sanction for the tourist-tax declaration is a percentage of the unpaid tax. Article 4, paragraph 1-ter, of Legislative Decree 23/2011 sets 100 percent of the unpaid tax for a missing declaration and 40 percent for an inaccurate one, each with a minimum of €50. A note on the Normattiva page says that, under article 12, paragraph 9, of Legislative Decree 147/2026, the provisions of its paragraphs 4 to 8 apply to violations committed from 1 January 2027. I could not confirm from that page how this changes paragraph 1-ter, so the principal should have an Italian tax adviser check the sanction in force.
How do Lake Como comuni set the tourist tax on short lets?
The tourist tax is a municipal act within a national ceiling. Article 4 of Legislative Decree 23/2011 lets the provincial capitals, unions of comuni and comuni on regional lists of tourist localities or art cities introduce it by council resolution. The default ceiling is €5 per night of stay, on a sliding scale tied to the price. Capitals with tourist presences at least twenty times their residents may go to a higher ceiling (measured, statutory text, version in force from 12 August 2026). A press report of 17 October 2025 described a proposed extension into 2026 of a temporary increase for provincial capitals, which include Como, conditional on a decree completing its passage, and this note did not confirm it on a statutory text (directional, press-reported).
The regulation decides the category, the rate and the exemptions. Each comune sets rules, exemptions and reductions in its own regulation under article 52 of Legislative Decree 446/1997. Paragraph 6 of article 208 adds that bodies entitled to the tax may introduce or reshape it. So the principal reads the regulation of the comune where the unit stands. The national text does not say whether a short let is a separate category in a given comune, nor how many nights are taxed.
For the lake comuni, no rate was found on an official text. On 24 October 2026 the municipal page opened on the site of the Comune di Como returned no content on the tax, and searches for the Como and Bellagio regulations returned no municipal document. This note therefore states no rate for any lake comune. A rate quoted for another city, or by a listing site, has no force on the lake.
The lake is many comuni with different regulations. A principal who holds units in two comuni reads two regulations. The tax is separate from the CIN, the CIR and the flat tax, and it is owed on the guest's stay. The purposes named in the national text are tourism, the upkeep of local cultural and environmental heritage and waste-collection costs, with urban security also allowed.

How do the four layers fit together on a Lake Como short let?
The layers run in parallel and each has its own clock. The CIN and the CIR attach to the unit and to its advertisement. The flat-tax text attaches to the owner's income in a tax year. The intermediary duties attach to the platform and fall due on 30 June of the following year. The tourist tax attaches to the guest's stay and to whoever collects the rent.
The CIN timeline rests on a Gazzetta notice that I did not reopen. Paragraph 15 of article 13-ter makes the article apply from the sixtieth day after the Gazzetta Ufficiale publishes the notice that the national database and the Ministry's portal are operational. Press reports place the start of sanctions in January 2025, after an extension (directional, press-reported). The date is history for a unit let in 2026, but a press date is not a basis for a legal question.
The tax side is the most recently rewritten. Between the budget law of 30 December 2025 and the income-tax code in force from 4 July 2026 and applicable from 1 January 2027, the apartment ceiling changed and the numbering and the location of the rate text were rewritten within about six months. The text can change again, as the note on Legislative Decree 147/2026 shows. Every reading here carries the date of 24 October 2026 and should be refreshed before use.
None of these texts is a price signal. Whether the compliance load of a short-let strategy changes how a lake property is valued is a market question, read in the official price data for Lake Como and not here. The texts fix duties, thresholds and sanctions. They say nothing about occupancy, nightly rates or net income, and this note offers no yield figure for any property.
Where a rate could not be found on an official text, this note says so and states no number.

What the evidence cannot show, honestly disclosed
The weakest point is the reading route for the income-tax articles. The Normattiva page for article 207 returned its index only. The text of articles 207 and 208 was read through a legal-database reproduction, and the Gazzetta Ufficiale PDF was not opened. The figures that depend on it are the 26 percent and 21 percent rates, the two-apartment ceiling, the 21 percent withholding and the 30 June deadlines. They are statutory figures (measured), with a reading route that is secondary.
Three gaps remain on the Lombardy side and the municipal side. The current coordinated text of regional law 27/2015 was not reopened on a regional site, and the Region's CIR page and a reproduction of regional law 7/2018 stand in for it. Whether Lombardy law sanctions a missing CIR, which would switch off the national fines under paragraph 10, was not established. No rate or regulation for Como, Bellagio or any other lake comune was found on an official text.
One reading rests on a secondary source. The relation between the CIN and the CIR comes from a CNA reproduction of the Ministry's FAQ, updated to 17 October 2024 (directional). The primary text presumes a business above two apartments and does not say how that presumption could be displaced. The status of paragraph 595 of Law 178/2020 after the income-tax code was not established, because the Normattiva page loaded in part. Nothing here is tax or legal advice, and a professional in Italy should read the texts for the unit and the owner.
Who lets on the lake and who buys there are separate questions. The buyer side is read in Lake Como Buyers: Reading the Shares. This note has no data on how many lake properties are let by the week, and that count was not found on an official text either.
