Serviced Residences: What the Label Covers
"Serviced residence" is market usage, not a legal category. Lombardy's tourism law, the national condhotel decree and a US mortgage guide each use different words for hotel services attached to homes. This note reads the words against their texts, shows where the split of shared-service costs is decided, and sets out what a US lender screens out.
IllustrationKey takeaways
- - 'Serviced residence' is market usage, not a defined category; Lombardy's Regional Law 27/2015 separates hotels, tourist-hotel residences, condhotels and holiday houses (Regione Lombardia, L.R. 27/2015 artt. 19 e 26).
- - A condhotel pairs rooms with residential units capped at 40% of the net surface assigned to rooms in the Lombardy text; Decree-Law 133/2014 art. 31 puts the base at the total surface of the compounds concerned (Regione Lombardia, L.R. 27/2015 art. 19; Normattiva, D.L. 133/2014 art. 31).
- - DPCM 13/2018 was published in Gazzetta Ufficiale n. 54 of 6 March 2018 and entered into force on 21 March 2018 (Normattiva, DPCM 22 gennaio 2018 n. 13, read on 17 October 2026).
- - The decree requires unified management for at least ten years from the start of operation (Normattiva, DPCM 13/2018 art. 4(1)(d)); the sale contract is reported to list the owner's costs (Lavoripubblici.it, 2018, press-reported, directional).
- - A casa vacanze is a unitary letting of residential units with optional complementary services, so the name implies no reception or cleaning (Regione Lombardia, L.R. 27/2015 art. 26, para. 1).
- - 'Branded residence' is not defined in the Italian texts read; the licence category and contract decide what is owned (Regione Lombardia, L.R. 27/2015; graded directional).
- - Fannie Mae's Selling Guide B4-2.1-03 treats hotel-managed projects, rental-pooling requirements and hotel-type services as ineligible, with a lender exception request possible (Fannie Mae, Selling Guide B4-2.1-03, topic dated 08/05/2026).
- - No yield, service-charge figure, residence threshold or tax rate is given, and no Italian lender policy was found; the US guide is a benchmark only (Victaura Research, 17 October 2026).

What does 'serviced residence' mean in Lombardy law?
In Lombardy, 'serviced residence' is not a legal category, and the regional tourism law splits the idea into separate words. Regional Law 27/2015 defines hotels by rooms, tourist-hotel residences by dwelling units, condhotels as hotels that add residential units with their own kitchens, and holiday houses and apartments as unitary lettings of residential units. Each word carries different duties, different services and different consequences for a buyer. The principal who reads a brochure label as if it were the statute risks mispricing what is owned.
A definition comes first. Condhotel is a hotel establishment open to the public, under unified management, that offers rooms and, in integrated and complementary form, residential dwelling units with an autonomous kitchen, whose surface may not exceed forty per cent of the net surface assigned to rooms (Regional Law 27/2015, art. 19, paragraph 4). The definition is a statute's, not a marketer's. It anchors every other term in this note.
This note explains words and does not rank projects. It reads three kinds of source. Regional and national Italian texts define the categories. A US mortgage guide shows how a lender treats hotel-type projects. A Civil Code article frames how shared costs are split. Every figure is graded. The sources were opened on 17 October 2026, and statutes change, so the principal should reopen the text before relying on a paragraph here.
Two limits apply from the start. The piece makes no promise of return and gives no personal advice. It names no operator, agency or manager unless a public act does. It reads Italian categories mostly through Lombardy because the regional text could be read in full. Other regions legislate separately and differ, since the national decree leaves implementation to them.
What is a tourist-hotel residence under Regional Law 27/2015?
A tourist-hotel residence is a lodging business whose capacity sits mainly in dwelling units. Article 19, paragraph 2 of Regional Law 27/2015 says residenze turistico-alberghiere are lodging structures with total or prevalent capacity in dwelling units, while paragraph 1 defines hotels as structures with total or prevalent capacity in rooms. The line is capacity, not a list of services. A structure with mostly apartments and a residual number of rooms falls on the residence side.
The category answers what is sold to the guest, not what is sold to the buyer. The article classifies a business that lets lodging to the public. It does not say that each dwelling unit is sold to a different person, and it does not say who owns the walls. A buyer who hears 'serviced residence' therefore learns the operating form of a building. The ownership form still has to come from the deed and the contract.
The article also leaves room for extra denominations. As summarised from the regional database on 17 October 2026, paragraph 5 allows hotel structures with particular services to carry an additional name, provided it is not misleading, and passes the criteria to the regulation foreseen by article 37. A name on a sign can therefore be an additional denomination and not a separate legal class. The principal should ask the seller which article of which text the denomination rests on.
The honest reading is narrow. The English word 'serviced' is not a defined term in the paragraphs read. 'Serviced residence' is market usage, and 'tourist-hotel residence' is the nearest statutory neighbour in Lombardy, not a translation. A seller who treats them as the same has made a claim that the text does not make.
What is a condhotel under DPCM 13/2018?
The condhotel is the one category where residential units are sold inside a hotel by national design. DPCM 22 January 2018, n. 13, a decree of the President of the Council of Ministers, implements article 31 of Decree-Law 133/2014. It was published in Gazzetta Ufficiale n. 54 of 6 March 2018 and entered into force on 21 March 2018 (Normattiva, read on 17 October 2026). It defines the condhotel as a hotel establishment open to the public, under unified management, combining rooms with residential dwelling units.
The forty per cent cap is the number that defines the format. Article 4(1)(b) of the decree sets the cap at forty per cent of the net surface assigned to rooms (Normattiva, read on 17 October 2026), and the Lombardy text uses the same base. The enabling Decree-Law 133/2014, article 31, paragraph 1, however, sets the cap at forty per cent of the total surface of the real-estate compounds concerned (Normattiva, read on 17 October 2026). The principal should read the current article before using the figure, because the base changes how much residential area a project can carry.
Management is unified and long. Article 4(1)(d) of the decree requires unified, integrated management of services and rooms for the period stated in the transfer contract and in any case not less than ten years from the start of the condhotel's operation. Article 4(1)(c) requires a single reception for guests and owners. The press summary of the decree adds that an owner's unit, when the owner is not using it and with the owner's consent, may be put to hotel use by the sole manager. That point is press-reported and graded directional.
Regions implement the decree. The Lombardy law carries its own condhotel paragraph, article 19, paragraph 4, which adds that the residential part may not benefit from volume increases granted by planning instruments to tourist-accommodation surface. Other regions legislate separately, and ANCE reported in March 2018 that Lombardy, Piedmont, Tuscany and Marche already had condhotel rules of their own. A condhotel in one region is not automatically the same instrument as a condhotel in another.
A label tells the principal what is sold. The statute and the contract tell the principal what is owned.

Is a casa vacanze the same as a serviced apartment?
A casa vacanze (CAV) is a unitary letting of ordinary residential units, not a hotel. Article 26, paragraph 1 of Regional Law 27/2015 defines case e appartamenti per vacanze as lodging structures run in a unitary manner to provide lodging and possibly complementary services in dwelling units, or parts of them, with residential destination, made up of one or more furnished rooms with bathroom facilities and a kitchen, located in one complex or in several.
The key words are 'possibly' and 'residential destination'. Complementary services are optional in the definition. The units keep their residential destination. A CAV therefore needs no reception, no restaurant and no daily cleaning to be a CAV, and a buyer should not infer any of them from the name. The specific minimum standards sit in the regional regulation r.r. 7/2016, which this note has not reproduced and does not summarise.
The CAV has its own identification regime. Regional Law 7/2018 added an identification code for holiday houses and apartments, and the Constitutional Court reviewed that provision in judgment n. 84 of 11 April 2019 after a challenge by the national government. The code and the category are administrative facts about a letting. They tell the principal how a unit may be offered to guests. They do not tell whether the unit is financeable or habitable all year.
The contrast with the condhotel is ownership logic. The CAV definition is silent on who owns the units. The condhotel rules build the sale of residential units into a hotel and attach contract content, a minimum management period and a cap. The words 'serviced apartment' can describe either, which is why the label alone settles nothing.
| Word | Where it is defined | Hotel services | Cost sharing | US agency lender reading |
|---|---|---|---|---|
| Tourist-hotel residence (closest statutory neighbour of 'serviced residence') | Regional Law 27/2015, art. 19, para. 2 (capacity mainly in dwelling units) | Not itemised in the definition | Not set by the definition | Not addressed by the Italian text; hotel-type operation is screened by the US guide |
| Casa vacanze (CAV) | Regional Law 27/2015, art. 26, para. 1 | Complementary services optional ('eventualmente') | Not set by the definition | Not addressed by the Italian text |
| Condhotel | Regional Law 27/2015, art. 19, para. 4; DPCM 13/2018 | Hotel under unified management; services described in the sale contract (press summary) | Contract must list owner's costs, including common-part maintenance (press summary) | A condo hotel or hotel-managed project is ineligible at Fannie Mae |
| Branded residence | Not defined in the Italian texts read | Set by management and licence agreements | Set by service-charge rules | Depends on the underlying legal form |
| Condo-hotel (US usage) | No Italian statute; US guide terms | Registration, daily cleaning, short-term rental screened | Set by HOA or hotel documents | Ineligible where hotel-managed or rental pooling is required (B4-2.1-03) |
What is a branded residence, and where does the label sit?
A branded residence is a commercial label for residential units that carry a hotel or design brand, and none of the Italian texts read here defines it. Neither Regional Law 27/2015 nor the condhotel decree uses the term in the paragraphs read. A principal who sees the phrase is looking at a licence and a marketing claim. The legal form is decided elsewhere, in the deed, the licence agreement and the building's rules.
The brand type changes the service logic. The difference between an operator brand and a design brand is treated in hotel-branded versus design-branded residences. This note stays on the legal words and leaves the brand comparison to that piece. The point to hold here is only that a logo says who licensed a name, and a licence category says what the building is.
The label can sit on top of several legal forms. In principle a branded residence could be a condhotel, a unit in an ordinary condominium with a separate services agreement, or a unit in a holiday-house scheme. That is a reading of how the categories could combine, not a finding about any building. The statute that applies depends on how the building is licensed and used, and the brand does not decide that.
The question to put to a seller is the licence category, in the words of the regional law. Hotel, tourist-hotel residence, condhotel or holiday-house scheme. Each answer opens a different set of duties. An answer that avoids those words is itself information.
Which hotel services does a unit buyer actually receive?
The services a buyer receives are the ones written into the transfer contract and the building rules. For condhotels, the press summary of the decree says the sale contract must describe the unit, its place in the establishment, and the common services and parts, together with the conditions of enjoyment and the way common facilities may be used. A service seen on a website and absent from the contract is a courtesy and not a right.
Italian definitions treat services as optional or as the operator's side. The CAV definition says 'possibly complementary services'. The condhotel definition in the underlying decree-law says the establishment provides lodging, accessory services and possibly food in rooms for accommodation and, in integrated form, in residential units. Read closely, the guest-facing service duty belongs to the operator, and the owner's entitlement is whatever the contract allocates. That is a reading of the wording, not a finding about any contract.
Hotel services have a US name for the same bundle. Fannie Mae's Selling Guide lists registration services, rentals of units on a daily or short-term basis, daily cleaning services, central telephone service, central key systems and restrictions on interior decorating as characteristics of a project that offers hotel-type services, including those offered by or contracted through the HOA (the homeowners' association) or management company (B4-2.1-03, topic dated 08/05/2026, read on 17 October 2026). The list is a useful vocabulary of what an underwriter means by hotel services.
The practical test is a three-column read. For each service, the principal can ask whether the contract promises it, who delivers it, and who pays. A service with no answer in one column is not a service the buyer owns. This is a reading method and not advice, and each answer has to come from a document.
Services follow contracts, and costs follow services.

Can a principal live in a serviced apartment all year?
Whether a unit can be lived in all year depends on its destination, its title and the building rules, and the label does not decide it. In a condhotel, the statute describes the units as dwelling units with residential destination and an autonomous kitchen, and the decree as reported contemplates the owner using the unit and, when the owner does not, a consented hotel use by the sole manager. That wording points to owner use as the baseline, though it does not state an occupancy right in terms.
A CAV keeps residential destination too, but its category is lodging. The definition describes a unitary letting of units to guests. A principal who intends to live in a unit that sits inside a CAV scheme needs the building rules and the licence status in writing. The category describes how the unit is offered, not how it may be inhabited.
Residence in law is a fact of habitual dwelling. Under Civil Code article 43, as reported in recent Cassation commentary, residence is the place of habitual abode, and a registered declaration carries strong probative weight against the person who made it. A search of case-law summaries on 17 October 2026 returned no ruling on registering as resident in a condhotel unit. An absent result is not an absent rule, and the principal should put the question to the municipality.
Residence thresholds and tax rates are not covered. This note cites no residence-day thresholds and no tax rates, because the only readings available were advisory websites and not the norm or an authority's notice. A principal who needs them should take them from the authority itself, in the text, with the date.
Will a US agency-backed lender finance a condo-hotel unit?
Under Fannie Mae's Selling Guide, a project managed and operated as a hotel is ineligible, and so is one whose documents require rental pooling. Section B4-2.1-03 lists as ineligible projects managed and operated as a hotel or motel even though the units are individually owned, timeshare, fractional or segmented ownership projects, and projects where the HOA or legal documents require owners to make units available for rental pooling, daily or otherwise (topic dated 08/05/2026 as displayed; Guide published 7 October 2026).
Hotel-type services are a second trigger. The same section treats a project as operating as a hotel if it meets one or more listed criteria, among them offering hotel-type services, including those offered by or contracted through the HOA or management company, or having obtained a hotel or resort rating. The section lets a lender request an exception for a project it believes has merit. An exception is a request, and nothing in the text says one will be granted.
Fannie Mae's waiver page repeats the point, and Freddie Mac uses a similar class. Section B4-2.1-02 lists among its requirements that the project is not a condo hotel or motel, a houseboat project, or a timeshare or segmented ownership project. Freddie Mac's Condo Project Advisor feedback messages, posted 8 December 2025, use the phrase 'Condominium Hotel or similar type of transient housing' for the same class, with a 'Not Eligible' result citing Guide section 5701.3(b). The Freddie Mac Guide text itself was not opened for this note.
This is a US benchmark, and it does not describe Italian banks. No Italian statute or public lender policy was found in this research, so whether an Italian lender finances a condhotel or CAV unit is a question for that lender, in writing. The US text matters because it shows what underwriters treat as hotel-like, namely rental obligations and daily services.
No yield is quoted here, because no public act quotes one.

What this reading does not establish
The condhotel text was read partly through secondary summaries. The decree's own page did not load as readable text at the first reading on 17 October 2026, so the contract content comes from a trade-press summary and is graded directional, press-reported. A later reading the same day opened article 4 on Normattiva. It confirms the ten-year minimum, the single reception and the forty per cent cap against the net surface of rooms. For the other points no article numbers are given, because the summary's numbering was inconsistent between readings.
The forty per cent base is contested in the sources. The Lombardy statute text and article 4(1)(b) of the decree use the net surface assigned to rooms. Decree-Law 133/2014, article 31, paragraph 1, uses the total surface of the real-estate compounds concerned. The principal cannot treat the figure as settled without reading the current article.
The Fannie Mae date is ambiguous. The topic is displayed as 08/05/2026 in US format, which reads as 5 August 2026, while the Guide page carried a publication line of 7 October 2026. A later version can change the wording, and the principal should reopen the section. The 'ineligible' reading here is a reading of that text at that time, not a standing fact.
Nothing here prices anything. There is no yield, no cost per square metre and no service-charge figure, because none was found in a public act. No Italian lender policy, no residence thresholds and no tax rates are covered. The note does not classify any Victaura project, and for project facts the public project pages govern. The grading used for the figures above follows the method in grading a number, our research method.
The words move. Regional Law 27/2015 has already been amended, for example by Regional Law 7/2018, and an administrative or constitutional ruling can change how a paragraph applies. A paragraph quoted here is a photograph at one date.
How should the principal read a label before relying on it?
Start with the licence category of the building, in the regional law's words. Is it a hotel, a tourist-hotel residence, a condhotel or a holiday-house scheme? Each answer opens a different question about services, cap and management. For what a room buyer owns inside a hotel structure, see what a condo-hotel room buyer owns.
Then read the contract for three things. The service list, the cost allocation and the exit terms, meaning how the unit can be resold and when the management arrangement can end. The decree, as reported, requires a description of the unit, services, common parts and costs. Anything the seller says that is not in the contract is not an entitlement, and anything in the building rules that overrides the contract needs to be found before signing.
Then test the finance question with the lender, not the brochure. Rental pooling obligations and daily hotel services are the features the US underwriting text screens for. The principal should ask any lender whether either feature affects financing, and should ask for the answer in writing.
Finally, treat the label as a hypothesis. 'Serviced residence', 'serviced apartment', 'casa vacanze', 'branded residence' and 'condo-hotel' are claims about a building. The statute, the licence and the contract are the evidence.

The Resale Test: Branded Residences After Handover
Savills places the average branded residence premium at roughly 33 per cent and publishes no separate figure for resales. Whether that premium survives the secondary market is a different question, and the industry rarely asks it in public. This dossier assembles the resale evidence, Dubai transaction records, two Miami towers with six to eight years of recorded sales, and the brand-removal natural experiments, and tests the premium where it matters: at exit. With branded residences forecast by CBRE at 54 per cent of Ras Al Khaimah's new supply in 2030 and Victaura holding an off-plan capital position there, the question is not academic. The conflicts are declared. The evidence decides, and where it cannot, the dossier says so.

Branded Residence Claims: How to Verify One
How does a principal verify that a scheme described as branded carries a signed brand, and which one? The answer is a sequence of checks against the brand's own list, the operator's disclosures, the trademark register, the local regulator and the contracts. Industry counts from Savills and Knight Frank are a cross-reference. They are not proof of any single scheme.

The Operator Premium, Measured
Branded residences sell on a headline premium that Savills puts at a 33 percent global average, but the figure is a market-average price comparison, not a resale-proven return, and it is quoted before the licensing fee the seller pays whether or not the brand adds value. This piece separates what the public data confirms from what the badge merely implies.
